Family Code: Royal Referral to Higher Council of Ulema Reinforces State of Institutions (Activist)


The Royal Referral to the Higher Council of Ulema, in order to contribute to the collective reflection on the the Family Code revision, reinforces the state of institutions and consolidates their role in the effective and efficient management of public affairs, stressed the coordinator of the “Parity now” collective and honorary president of Socialist International Women, Ouafae Hajji.

Hajji told MAP that this referral is part of an institutional approach aimed at formulating proposals on the basis of Ijtihad, noting that seeking the Council’s opinion on this issue bears witness to the role played by institutions in crucial national issues.

The work of the Higher Council of Ulema will make it possible to provide opinions within the framework of an Ijtihad in phase with the development and evolution of Moroccan society, so as to achieve a global reform in favor of solutions for a fulfilled family, she explained, taking into account that any Ijtihad must be carried out in an orderly and well-organized manner.

This Royal initiative is also at the heart of the process initiated by the Sovereign following the Royal letter addressed to the Head of Government on the revision of the Family Code, she added.

HM King Mohammed VI, President of the Higher Council of Ulema, had given His High Directives to the said Council to examine certain issues contained in the proposals of the body in charge of revising the Family Code, with reference to the principles and precepts of the holy religion of Islam and its tolerant purposes, and to submit a Fatwa on the subject to the High Appreciation of the Sovereign.
